Arizona Statutory Rape Law Constitutional

  I have always thought the it is none of the government's business who a person has sex with, and that any laws making it illegal for minors to have sex are morally wrong.

Of course don't count on the courts siding with me for many years. In this case the court said you are guilty of statutory rape if you have sex with a person under 18, even if you think the person is over 18.

Arizona law against sex with minors upheld by ruling

PHOENIX - A new court ruling upholds the constitutionality of an Arizona law that bars sexual intercourse with a person who is under 18 years of age.

A man convicted of the crime argued in his appeal that there needs to be proof that the defendant knew the age of the victim and that he should have been allowed to argue that he believed the victim was 18 years old.

But a ruling by a three-judge state Court of Appeals panel upholds the man's conviction.

It said the prosecution must prove the victim's age at the time of the offense but is not required to prove the defendant's knowledge of the victim's age.
